It is also designed to prevent an overreliance on foreign labor yet still permitting businesses to benefit from international expertise.<\/p>\n<p class=\"\" data-start=\"1603\" data-end=\"2109\">This 85% threshold is calculated based on the total number of employees that are under contract. However, there are exemptions to this rule which state that companies which require specific skills or expertise not readily available in the country can hire foreign professionals beyond the limit, as long as they can justify the necessity of doing so. Business areas such as <strong data-start=\"1977\" data-end=\"2002\">mining and technology<\/strong> which often require niche expertise are permitted to apply for exemptions when hiring foreign specialists.<\/p>\n<p class=\"\" data-start=\"2111\" data-end=\"2631\">The law also does not discriminate against long-term foreign workers. For example, an employee who has resided in Chile for more than five years, whether this be continuously or intermittently, is considered equivalent to a Chilean resident under this regulation. As a result, long-term foreign residents are able to integrate into the workforce. This is particularly valuable since it allows companies to benefit from the expertise of international workers without affecting the company\u2019s compliance with the labor law.<\/p>\n<p class=\"\" data-start=\"2633\" data-end=\"2982\">This law is not intended to deter foreign investment or limit economic growth. Instead, it looks to strike a balance between maintaining job opportunities for Chileans and recognising the positive contribution of international talent. Therefore, the law allows businesses to address skill shortages whilst remaining competitive in the global market.<\/p>\n<p class=\"\" data-start=\"2984\" data-end=\"3305\">It is important to note that <strong data-start=\"3013\" data-end=\"3073\">employment contracts in Chile must be drafted in Spanish<\/strong> and specify the essential terms of employment including the duration, the tasks they will perform and the working conditions. Benefits, such as <strong data-start=\"3218\" data-end=\"3271\">health insurance, vacation and leave entitlements<\/strong>, should also be clearly outlined.<\/p>\n<p class=\"\" data-start=\"3307\" data-end=\"3742\"><strong data-start=\"3307\" data-end=\"3323\">Labor unions<\/strong> play a pivotal role in Chile, exerting significant influence over labor relations and workplace conditions. Businesses must comply with <strong data-start=\"3460\" data-end=\"3503\">collective bargaining agreements (CBAs)<\/strong>, legally binding agreements which establish terms of employment such as wages and working hours. These are negotiated between unions and employers, making compliance essential to avoid conflicts and maintain a productive work environment.<\/p>\n<h2 class=\"\" data-start=\"3744\" data-end=\"3779\"><strong data-start=\"3747\" data-end=\"3779\">2. Tax and Contractual Risks<\/strong><\/h2>\n<p class=\"\" data-start=\"3781\" data-end=\"3971\">Tax and contractual risks are crucial considerations for businesses in Chile. <strong data-start=\"3859\" data-end=\"3900\">Failure to comply with local tax laws<\/strong>, including incorrect reporting of income can cause tax risks to arise.<\/p>\n<p class=\"\" data-start=\"3973\" data-end=\"4706\">Chile applies a <strong data-start=\"3989\" data-end=\"4015\">27% corporate tax rate<\/strong> for businesses that pay under the semi-integrated or partial use of the first category tax credit. The first category tax applies to companies\u2019 that pay the first category tax on their earnings. Individuals residing in Chile for up to three years are only taxed on their Chilean-source income. This means that income they earn within Chile, such as wages from a local employer or profits made from a business operating in Chile, is taxable by tax authorities. However, they are not required to pay taxes on foreign-source income. This includes salaries from an overseas employer or business profits earned outside Chile. After this period, individuals are subject to <strong data-start=\"4683\" data-end=\"4705\">worldwide taxation<\/strong>.<\/p>\n<h3 class=\"\" data-start=\"4708\" data-end=\"4729\"><strong data-start=\"4712\" data-end=\"4729\">Corporate Tax<\/strong><\/h3>\n<p class=\"\" data-start=\"4731\" data-end=\"5135\">Income from activities that involve the use of capital are subject to taxation of 27%, this is applicable to all businesses. Financial statements and accounting records are usually used to determine taxable income. Corporate tax paid by the company is noted down in a special tax account called the <strong data-start=\"5030\" data-end=\"5066\">accumulated credit balance (SAC)<\/strong> and can be used as a credit against the owner\u2019s personal income tax.<\/p>\n<p class=\"\" data-start=\"5137\" data-end=\"5558\">Small and medium-sized businesses can benefit from a <strong data-start=\"5190\" data-end=\"5208\">25% tax system<\/strong>. Instead of using financial statements, their taxes are based on actual cash flow and if a business has more expenses than income, it can carry those losses forward to reduce future taxes. From 2020 to 2023, an exception allowed businesses to use these losses to reduce taxes on dividends and profit withdrawals, but the benefit decreased each year.<\/p>\n<h3 class=\"\" data-start=\"5560\" data-end=\"5594\"><strong data-start=\"5564\" data-end=\"5594\">Personal Income Tax (IRPF)<\/strong><\/h3>\n<p class=\"\" data-start=\"5596\" data-end=\"5862\">Employees are subject to a <strong data-start=\"5623\" data-end=\"5642\">progressive tax<\/strong> calculated monthly on income from employment. This has a maximum rate of <strong data-start=\"5716\" data-end=\"5723\">40%<\/strong>. It is also possible for residents to be subject to a global complementary tax, assessed on total income, also with a maximum rate of 40%.<\/p>\n<h3 class=\"\" data-start=\"5864\" data-end=\"5902\"><strong data-start=\"5868\" data-end=\"5902\">Non-Resident Income Tax (IRNR)<\/strong><\/h3>\n<p class=\"\" data-start=\"5904\" data-end=\"6248\">Non-Chilean residents and foreign companies pay an <strong data-start=\"5955\" data-end=\"5973\">additional tax<\/strong> on their income from Chile. A <strong data-start=\"6004\" data-end=\"6015\">15% tax<\/strong>, known as flat tax, is generally applied on activities including technical or engineering work, or professional services. In other instances, for example if the company paying tax is based in a tax haven, different rates will apply.<\/p>\n<h3 class=\"\" data-start=\"6250\" data-end=\"6268\"><strong data-start=\"6254\" data-end=\"6268\">Wealth Tax<\/strong><\/h3>\n<p class=\"\" data-start=\"6270\" data-end=\"6390\">Wealth tax, a tax levied on the total value of a person\u2019s assets, rather than their income, <strong data-start=\"6362\" data-end=\"6389\">does not exist in Chile<\/strong>.<\/p>\n<h3 class=\"\" data-start=\"6392\" data-end=\"6421\"><strong data-start=\"6396\" data-end=\"6421\">Value Added Tax (VAT)<\/strong><\/h3>\n<p class=\"\" data-start=\"6423\" data-end=\"6793\"><strong data-start=\"6423\" data-end=\"6456\">VAT in Chile is currently 19%<\/strong> of the transaction value, paid by the supplier of goods or services. For imports, the taxable base is dependent on the CIF (cost, insurance and freight) value, as established by the Customs Service, \u201cServicio Nacional de Aduanas\u201d. Taxpayers must file a <strong data-start=\"6710\" data-end=\"6732\">monthly tax return<\/strong> and can carry forward any used VAT credit for future months.<\/p>\n<p class=\"\" data-start=\"6795\" data-end=\"7189\">Non-Chilean resident service providers offering certain services in Chile must also register with the Internal Revenue Service (SII). They must charge and collect VAT from non-VAT-paying users in Chile and file their taxes every quarter. However, <strong data-start=\"7042\" data-end=\"7087\">exports of all goods and certain services<\/strong> are not subject to VAT. Businesses can deduct or receive a refund for VAT paid on necessary expenses.<\/p>\n<h2 class=\"\" data-start=\"7191\" data-end=\"7227\"><strong data-start=\"7194\" data-end=\"7227\">3. Visas and Permits in Chile<\/strong><\/h2>\n<p class=\"\" data-start=\"7229\" data-end=\"7607\">Foreign investors working in Chile must ensure they have the appropriate <strong data-start=\"7302\" data-end=\"7326\">visa and work permit<\/strong> to legally operate in the country. There are various visa options offered, including the <strong data-start=\"7416\" data-end=\"7473\">Investor Visa, Work Visa and Temporary Residence Visa<\/strong>.
